1. Vault Pays-enabled Prepaid Single-Use Mastercard Terms and Conditions

For the purpose of these terms:

(a) ‘We, Us and Our’ means Vault Payment Solutions Group Pty Ltd, ABN 66 632 373 105,  Level 3.2/13 Cremorne Street, Cremorne VIC 3121 Australia (“Vault”);

(b) ‘You’ means the Card purchaser or user who has acquired the Card;

(c) ‘Pays’ means Apple Pay, Google Pay or Samsung Pay;

(d) ‘Card’ means the Vault Pays-enabled Prepaid Mastercard issued by EML Payment Solutions Limited, ABN 30 131 436 532 and distributed by Vault; and

(e) ‘Device’, means a mobile phone or wearable device that allows you to store a Card to the Device.

 

1. By allowing the addition of the Card into your Pays-enabled Device, you agree to be bound by these Terms and Conditions.

How the Card works

2. The Card is a Mastercard prepaid card that can be used for purchasing goods and services where the Card is accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions). The Card cannot be used as a credit card and cannot be linked to any deposit account. Some merchants may not accept the Card.

3. The Card cannot be used to make transactions that exceed the Card’s available balance. To complete such a transaction you will need to pay the difference by another method, if the merchant agrees.

4. The Card is not reloadable, and is only valid and useable until the expiry date shown on the front of the Card. Upon expiry, the remaining available balance is forfeited. We will not give you any notice before this happens.

5. Once issued to You, the Card must be activated using an activation code before the activation expiry date. The activation expiry date is stated in the SMS or Email you received with your card. Failure to activate before the activation expiry will result in the balance being forfeited. You will be supplied with an activation code.

6. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments. Authorisations may be declined at some merchants (such as gambling merchants or merchants who choose not to accept the Card). We are not liable in any way when authorisation is declined for any particular transaction, except where the authorisation has been declined because of an act or omission on our part.

Fees

7. We will not charge any fees for using the Card. However, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction.

8. A 2.99% foreign exchange conversion fee applies to any transactions in a currency other than Australian dollars and is calculated on the Australian dollar transaction amount. This will be included in the total transaction amount debited to the Card.

Your Obligations

9. You are responsible for all transactions on the Card, except where there has been fraud or negligence by our employees or agents. If you notice any error relating to the Card, you should immediately notify Vault Client Services on (03) 9000 0012 during business hours or alternatively you can send an email to info@vaultpaymentsolutions.com.au.

10. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact Vault Client Services on (03) 9000 0012 during business hours or alternatively you can send an email to info@vaultpaymentsolutions.com.au.

11. You are responsible for checking your transaction history, knowing the available balance and date of expiry for the Card, all of which is available to you on your Device.

Liability

12. We are not liable in circumstances where you have other cards stored on your Device for payment and you inadvertently use the Card when using your Device as a payment method. You must ensure that you select the correct card prior to using your Device as a payment method.

13. We are not liable for the use, functionality or availability of a Device, the availability of merchants who allow the use of the Card as payment, or a reduced level of service caused by the failure of third party communication and network providers (except to the extent deemed liable under the ePayments Code).

14. We are not liable for transactions on your Card if:
a) your Device security measures are compromised;
b) where you allow others access to, or the means to access, your Device; or
c) any other circumstances in which you allow others to circumvent the security measures of your Device.

15. To the extent permitted by law, We:
a) exclude all statutory or implied conditions and warranties and any other liability We may have to you (including liability for indirect or consequential loss) that may arise under statute or at law including without limitation for breach of contract, in tort (including negligence) or under any other cause of action howsoever arising out of, or in any way related to, the use of the Card and our goods and services;
b) limit our liability under any condition or warranty which cannot be legally excluded in relation to the supply of goods or services to (at our election) replacing the goods or services or supplying equivalent goods or services again; and
c) make no warranties or representations about our goods or services or the content related to our goods and services, including but not limited to warranties or representations; that such content will be complete, accurate or up-to-date or that access to the Card or related services will be uninterrupted, error-free or free from viruses.

Our Rights

16. We may restrict or stop the use of the Card if suspicious activities are noticed.

Refunds

17. Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of applying a credit to the Card, cash refund or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.

Privacy

19. Information will be disclosed to third parties about the Card, or transactions made with the Card, whenever allowed by law, and also where necessary to operate the Card and process transactions. A full privacy policy can be viewed at https://www.vaultps.com.au/privacy-policy.

Changes to Terms and Conditions

20. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions can be viewed at www.vaultps.com.au.

 

 

2. Vault Physical Mastercard® Single Use Gift Card Terms and Conditions

These Terms and Conditions apply to your Vault Mastercard prepaid gift card (“the Card”). The Card is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 (“EML”) pursuant to license by Mastercard Asia/Pacific Pte. Ltd. and distributed by Vault Payment Solutions Group Pty Ltd ABN 632 373 105 (“Vault”). In these Card terms and conditions, we, us or our means EML and Vault; and you, your or user means the cardholder. If you acquire the Card, you will have a contract with us.

Accepting the Card and agreeing to these Conditions of Use

You agree to be bound by these Terms and Conditions by using the Card in any capacity including, but not limited to signing the back of the Card, activating the Card, using any Card features or completing a transaction with the Card.

How and where you can use the Card

The Card is a single load prepaid Mastercard gift card that can be used for purchasing goods and services where Mastercard prepaid cards are accepted (excluding transactions at ATMs or over the counter at financial institutions).

The Card is not reloadable and must be activated prior to use and expiry. To activate the Card, you must follow the activation steps listed on the letter that came with the Card and on the activation website https://vaultactivation.com.au/#/ .

The Card must be activated within the period specified on the letter that came with the Card. Failure to activate the Card within the specified period will result in Card expiry. At expiry, all funds remaining on the card will be forfeited. We will not give you notice before this happens.

When using the Card at point of sale, if required, press the Credit button to access the available balance.

When using the Card at point of sale, you may be required to use the PIN specified on the letter that came with the Card to complete transactions over a certain value (typically, when a transaction exceeds ninety-nine ($99) dollars).

The Card does not have cash out capability. You may not use the Card to withdraw cash.

The Card cannot be used for making direct debit, recurring, or regular instalment payments. Use of the Card may be declined at some merchants (such as gambling merchants or merchants who choose not to accept the Card).

The Card is not a credit card and nor is it linked to a deposit account with us and there is no interest payable to you on the available balance on the Card.)

Checking your Card balance and transaction history

You acknowledge and agree that we do not provide you with paper statements. Card transaction activity and balance information can be found by visiting www.vaultactivation.com.au/#/balance and entering the Card EAID (the 9 character alphanumeric identifier printed on the back of the Card).
You are responsible for checking your transaction history and knowing the available balance for the Card, all of which will be available to you by visiting www.vaultactivation.com.au/#/balance and entering the Card EAID.
You are responsible for ensuring the availability of sufficient funds for all transactions. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.
In the event the available amount on the Card is less than the purchase amount, some Merchants may not allow the Cardholder to combine multiple payment types (such as cash, cheque or another payment card) to complete the transaction.

Validity and Card Expiry

The Card is valid until the expiry date shown on the Card and cannot be used after expiry. At expiry, the remaining available balance will be forfeited. We will not give you any notice before this happens.

The Card expiry date is located at the front of the Card.

Your Card, your responsibility

The Card is like cash. We have no obligation to replace or refund value for misused, lost, stolen or damaged Cards except where we have breached any condition or warranty implied under consumer protection legislation that cannot be excluded in these terms and conditions (for example, warranties as to the exercise of due care and skill in providing services and as to fitness for purpose of materials we provide).

You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents. If you notice any error relating to the Card, you should notify Vault Client Services immediately on (03) 9000 0012 during business hours or alternatively, you can send an email to info@valutpaymentsolutions.com.au .

Except to the extent required by law, we are not liable for any loss or damage arising out of or in any way related to the use of the Cards, including:

(a) if authorisation is declined for any transaction, except where the authorisation has been declined because of an act or omission on our part;

(b) if you permit someone else to use the Card, you will be responsible for any transactions initiated by that person with the Card;

(c) the availability of merchants who allow the use of the Card as payment;

(d) reduced levels of service caused by the failure of third-party communications and network providers (except to the extent deemed liable under the ePayments Code).

Unauthorised transactions can occur with the Card if it is lost or stolen, a personal identification number (“PIN”) is revealed to any other person, or because of fraud.

We are not liable in any way if your Card is lost or stolen, or if funds are misappropriated. If your card is lost or stolen please visit info@vaultpaymentsolutions.com.au to contact us for further assistance.

Errors and complaints

If we discover an error in the amount of funds loaded, reloaded, received or used for any reason, we are authorised to rectify the error without further notice to you, including but not limited to debiting the equal amount of funds found in error from your Cards available balance.

Fees and Charges

We do not charge any fees for using the Card except for those stated in the table below. However, to the extent permitted by law, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction.

You agree to pay and authorise us to debit from the Card’s balance all fees and charges listed in the table below immediately as they are incurred.

Limitations of use of the Card

We may delay, suspend, block or terminate the processing of any transaction, without incurring any liability if:
(a) we suspect the transaction involves, in any way, illicit proceeds, illicit conduct or relates to an unlawful purpose;

(b) we suspect the transaction may be in breach of any laws and regulations in Australia or any other country.

(c) we discover you have breached these Terms and Conditions;

(d) you provide inaccurate, incomplete, false or deceptive information when acquiring or using the Card.

Refunds or exchanges

Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the Card or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund then you will have no access to those funds.
You cannot “stop payment” on any transaction after it has been completed. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact CPC Customer Support.

Privacy

Information will be disclosed to third parties about the Card, or transactions made with the Card, whenever allowed by law, and where necessary to operate the Card and process transactions. Our Privacy Policies are available at:

3. Vault Prepaid eftpos Card Terms and Conditions

For the purpose of these terms:

(a) ‘We, Us and Our’ means Vault Payment Solutions Group Pty Ltd, ABN 66 632 373 105 (‘Vault’);

(b) ‘You’ means the Card purchaser or user who has acquired the Card;

(c) ‘Card’ means the Vault Prepaid eftpos Card issued by EML Payment Solutions Limited ABN 30 131 436 532 (‘EML’) and authorised by EML to be distributed by Vault.

By using the Card You agree to these Terms and Conditions herein.

How to Activate Your Card

If Your Card has an issue date displayed on the Card the Card must be activated within the time period specified on Your Card. Cards not activated within the timeframe specified on the Card will expire and any prepaid funds shall be forfeited. We will not give You any notice before this happens.

If Your Card does not have an issue date displayed on the Card, it must be activated within the date specified on the letter you receive with Your Card. Cards not activated within the timeframe specified on the letter will expire and any prepaid funds shall be forfeited. We will not give You any notice before this happens.

To activate Your Card, You must register and enter in Your Card details online at www.vaultactivation.com.au. Once activated, funds will be available by 12 pm the next business day.

Use of the Card

Following activation Your Card is only valid for 12 months. Once Your Card has expired it cannot be used or replaced and any remaining balance will be forfeited. We will not give You any notice before this happens.

Your Card may be used for purchasing goods and services wherever eftpos cards are accepted for electronic transactions.

You cannot reload Your Card with any additional funds.

You are responsible for checking your transaction history online and knowing Your available balance by viewing Your transaction activity. To check Your Card balance, Card expiry and full conditions of use, visit www.vaultactivation.com.au and enter Your Card details.

Your Card is not a credit card and it is not linked to any deposit account with Vault, EML or otherwise.

Your Card cannot be used to complete transactions that exceed the available balance on the Card. For such a transaction, You will need to pay the difference by another method, if the merchant agrees.

Your Card cannot be used to obtain or redeem cash; or make direct debit recurring or regular instalment payments.

Authorisations may be declined at some merchants (such as gambling merchants or merchants who choose not to accept eftpos prepaid gift cards).

Your Card remains Our property and We or EML may restrict or stop the use of the Card if suspicious activities are noticed. To check full conditions of use, visit www.vaultactivation.com.au.

Your Card is like cash and may not be replaced if misused, lost, stolen or damaged. You are responsible for all transactions on the Card, except where there has been fraud or negligence by Us, Our staff or agents.

Liability

We not liable in any way should a payment authorisation be declined for a particular transaction, except where the authorisation has been declined due to Our act or omission.

We are not liable for the use, functionality and availability of the Card or the availability of merchants who allow the use of the Card as payment.

If You have a problem with a purchase made with Your Card, or a dispute with a merchant, You must deal directly with the merchant involved. If You cannot resolve the dispute with the merchant, You can contact Vault Customer Service immediately during business hours or alternatively You can send an email to info@vaultpaymentsolutions.com.au.
If You wish to make a complaint about Your Card you can send an email to support@emlpayments.com.au.

4. Vault Private Label Prepaid Gift Card Terms and Conditions

These Terms and Conditions apply to your Vault prepaid card (“the Card”).

The Card is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 (“EML”) and distributed by Vault Payment Solutions Group Pty Ltd, ABN 66 632 373 105 (“Vault”). In these Card terms and conditions, “we”, “us” or “our” means EML and Vault; and “you”, “your” or “user” means the cardholder. If you acquire the Card you will have a contract with us.

When we refer to a Physical Card it means a plastic card issued by EML and when we refer to a Tokenised Card it means a card that has had sensitive personal information (including, but not limited to, a PAN) is substituted for a unique identifier (token) and stored within a Device Wallet for you to use as payment. A Tokenised Card can be used for Contactless Transactions as well as card not present transactions, including online purchases.

When we refer to a Digital Wallet, we are referring to Apple Pay, Google Pay or Samsung Pay or any other digital wallet provider capable of provisioning the Card to your Device and when we refer to a Device, we are referring to a mobile or wearable device that allows you to store or otherwise add a Card to a Digital Wallet.

Website means the secured web site https://www.vaultps.com.au/terms and any additional or replacement website we notify you as the website for the purposes of these Terms & Conditions from time to time.
App means the mobile application provided by Vault which allows you to manage your Card, review transactions and check your available balance.

Accepting the Card and agreeing to these Conditions of Use
1. You agree to be bound by these Terms and Conditions by using the Card in any capacity including, but not limited to, provisioning the Card into your Device, using any Card features or completing a transaction with the Card.

2. Use and access to the Tokenised Card is subject to your respective Device capability. This means your Device must have the ability to store the Tokenised Card and make a purchase using a Digital Wallet.

How and where you can use the Card
3. The Card must be activated prior to use and expiry.
a. For a Physical Card, via the website by following the prompts;
b. For a Tokenised Card, via the App by following the instructions provided to you via text message to your Device;

4. Upon activation, the Card will be ready for use from 12pm the following business day;

5. If the Card is not activated within the activation period as defined on the Website, it will be cancelled for non-activation, and the available balance will be forfeited.

6. The Card is a single load prepaid card that can be used for purchasing goods and services at merchants as defined on the website and cannot be used at ATMs or over the counter at financial institutions.
a. at an Accepted Merchant that has an EFTPOS Device by either:
i. swiping a Physical Card and selecting the ‘credit’ button ; or
ii. for a Tokenised Card, making a Contactless Transaction.
b. Over the telephone or the internet at an Accepted Merchant by providing the Card Number, expiry date and security code.

7. Attempts to use the Card at merchants that are not otherwise approved to accept the Card will result in a declined transaction.

8. The Card must be activated prior to use and expiry. To activate the Card, you must follow the activation steps at https://vaultactivation.com.au.

9. If the Card is not activated within (activation period) from the date of issue, it will be closed, and the available balance will be forfeited and paid to Vault.

10. When using the Card at point of sale, if required, press the Credit button to access the available balance.

11. The Card does not have cash out capability. You may not use the Card to withdraw cash.

12. The Card cannot be cancelled, used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments.

Checking your Card balance and transaction history

Validity and Card Expiry
17. Once Activated, the Card is valid until the expiry date shown:
a. For a Physical Card, on the card itself.
b. For a Tokenised card, within the App or your Digital Wallet.

18. The Card cannot be used after expiry. After its expiry, or cancellation for non-activation, any balance will be forfeited to Vault, and the Card will be declined when presented for use. We will not give you any notice before this happens.

Your Card, your responsibility
19. The Card is like cash.
